Apple is at war on a number of fronts over patents especially in the mobile space. Android is a threat to iOS and some see it as a knock off that has allowed handset manufactures to produce phones that look remarkably similar to iPhone and tables that look remarkably similar to the iPad.

All patent battles tend to end up ugly and the Apple Samsung is no exception. Apple recently won an injunction against the Galexy Nexus from being sold in the USA. Samsung are not happy and are going through the appeal process.

The judge, Luck Koh, commented at the time that “although Samsung has a right to compete, it does not have a right to compete unfairly, by flooding the market with infringing products.” That’s pretty harsh comments from a judge.

Not so Florain Mueller of FOSS Patents. His blog lists the patents are the root of the dispute. We love U.S. Patent No. 5,946,647 on a “system and method for performing an action on a structure in computer-generated data” What a great title. Read more at Foss.

You know how when you tap a phone number in another app (like Mail) and it switches to the dialer app because it knows you want to call someone?

Apple owns the rights to this. Samsung and HTC phones violated this patent.

The United States International Trade Commission (ITC) deemed this patent valid and infringed in a December 19, 2011 order of a U.S. import ban against HTC.

In a June 29, 2012 order of a preliminary injunction against the Galaxy Nexus smartphone, the United States District Court for the Northern District of California deemed this patent valid and infringed, but denied an injunction on the basis of this patent for balance-of-hardships reasons.

Motorola Mobility failed with summary judgment motions in a litigation in the Northern District of Illinois to prove this patent invalid or not infringed. The recent dismissal of that lawsuit was based on other reasons than the merit of Apple’s infringement claims.

The iPad has created an industry and new entrants are hungry to join Apple at the trough. Samsung have just released the Galaxy, a 7 inch tablet device. Initial reviews have been lees that exciting with some major concerns about the screen size and functionality. Gizmodo called it a portable train wreck.

That’s a harsh but probably fair comment. Mr Jobs laboured the point about screen size in the recent earnings release. He used basic trig to show that an 11 inch device has roughly twice the amount of real estate compared to a 7 inch device.  The device is of course powered by Android.

Early next year will see the RIM project take light. This is another 7 inch device from Canadian heavy weight and blackberry maker RIM. The company has a loyal following in the smartphone set and is the product of choice for many millions of consumers and business. The will however miss this years Christmas or Holiday spending bonanza.

The FT has a report that Dell are planning to launch an Android handset in China and has showed an early version with China Mobile.

Of course iPhone is still not launched in China and there are many rumors of the supposed carrier and stories of  purchases of a gazillion handsets. We may know soon or we may not.
